His beard had just grown on his face. It is the great discovery of Dr Jalil Popalzai who find an important document in Archives Library Peshawar and then he provided a copy of it to Anwat khan Dewana who published it on the last page of his book "Zamin kha gayi asman kaisay kaisay" that Says: "Weekly Report of NWFP Secret Police of 1931 Vol. XXVII, Page 59, Paragraph No 98, Dated 21. 2. 1931. "The important event of this week is the murder attemp on Asstt Commissioner of Charsadda Captain Bunes by an Utmanzai Momand, Habib Nur at his Bunglow. He fired at the AC but his target missed him. The Orderly at the Bungalow of Burnes overpowered him. Case was filed in the court of the Session Judge under Ghazi Actand was hanged to death on 19. 02. 1931. Habib Nur said in his statement that the Revolver and 18 bullets were given to him by the son of Haji Sahib Turangzai, Badshah Gul". Ahmad Kaka had written in detail on Habib Nur in his "Khudai khidmatgar Tehreek" Pp. 421-44. Ahmad Kaka states that that event occurred on 27 Ramada in November. Ahmad Kaka is near to the truth that it was 29 Ramadan but not November, rather this was 17 February 1931 that falls on 29 Ramadan. Ahmad Kaka says that the police insisted him to record the statement that he had done this on the directive of Abdul Ghafar Khan. You will be acquitted then. But he did not knew Abdula Ghafar Khan (Bacha Khan) and denied their statement altogether. On the night of Hanging another guided flatter came to Habib Nur's cell in jail and feigned weeping and telling him to admit that I had committed this crime on the direction of Bacha Khan. Habib Nur replied, "I heard it from Imam that before death in the state of moribund the devils come to people and misguide them. Habib Nur was caught by the orderly, a resident of Mohallah Kamangaro Charsadda and was taken to Peshawar to the Court of the Session Judge. The hearing took place till noon and a few hours later a death order was passed on him. Appeal etc in court were dismissed. He passed the night in jail on 19 February (In Calendar it was the day of Eid ul Fitr) he was hanged to death. Mahabat Orderly was allotted 10 Jarib land in Abazo. The section under which Habib Nur was hanged to death is commonly called Ghazi Act and in the legal term it is called "Frontier Murderous Outrages Regulation (IV of 1901): A Regulation to make better provision for the suppression of murderous outrages in certain frontier tracts". The Murderous Outrages Regulation (or Act) refers to several pieces of legislation in 19th century British India (which then included modern Pakistan) that gave the colonial government additional powers to prosecute serious crimes such as murder. It is strange that Habib Nur made an attempt of murder and he should have been trialed under section 302 if he had killed the victim. He made an attempt of killing in which the victim was not killed, therefore, he should have been tried under section 307. But Ghulam Sarwar Khan PP of Dwa Saro said that this kind of offense is tried under Ghazi Act 1818 of Bengal Regulation Ordinance. It was the justice of the British Govt that was condemned by the general Public. Poet praised Habib Nur in their poetry and people in the Tapas. The Afghan Warrior Poet Khushal Khan Khattak Says, "The brave people are chanted in song and in eulogies". So Habib Nur chanted. He became so popular that a famous poet of India and editor of Zamindar Newspaper also paid him tribute in his verses. Maulanaz Zafar Ali Khan paid him rich tributes in these verses.
